Terms of Service
These terms govern your access to and use of Capital Rush. By using the platform you agree to them. Please read them carefully, along with our Risk Disclaimer and Privacy Policy.
1. What Capital Rush is.
Capital Rush is a signal and automation platform for futures trading on funded and proprietary ("prop") trading accounts. We provide trade alerts and optional automated execution paths that can place orders on a brokerage or prop-firm account you connect. Capital Rush is a software and information service only.
Capital Rush is not a broker, not a futures commission merchant (FCM), not a commodity trading advisor, and not an investment adviser. We do not hold customer funds, we do not open or fund trading accounts, and we do not provide personalized investment advice. The trade alerts and automation we provide are informational and are applied to accounts you own and control.
2. Who may use Capital Rush.
You must be at least 18 years old and able to form a legally binding contract to use the platform. By using Capital Rush you represent that you meet these requirements and that your use complies with all laws and regulations that apply to you.
3. Account responsibilities.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Do not share your account with others. Notify us promptly if you suspect unauthorized access.
You are solely responsible for your funded, prop, or brokerage accounts, including maintaining them in good standing and following every rule, parameter, and limit set by the firm or broker that provides them. Any connection you make and any credentials you supply are provided by you so that Capital Rush can route the trades you authorize.
4. Subscription and billing.
Paid subscriptions are processed through Commas, our billing processor. Subscriptions are recurring and renew automatically each billing cycle until you cancel. You can cancel at any time to stop future charges; cancellation takes effect at the end of the current billing period.
Refunds are governed by our Refund Policy, including the 30-Day Risk-Free Guarantee described there. Except as stated in that policy or as required by law, payments are non-refundable and we do not provide partial refunds for unused time.
5. Acceptable use.
You agree not to:
(a) use the platform for any unlawful purpose or in violation of any prop-firm or broker rules; (b) attempt to reverse engineer, scrape, resell, or redistribute the platform, its signals, or its data; (c) interfere with or disrupt the platform's operation or security; (d) share, resell, or relay trade alerts to third parties; or (e) misrepresent your identity or provide credentials you are not authorized to use.
6. Intellectual property.
The platform, including its software, models, signals, analytics, content, and branding, is owned by Capital Rush and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the platform for your own trading while your subscription is active. You may not copy, modify, distribute, or create derivative works from any part of the platform without our written permission.
7. Not financial or investment advice. No guarantee of profits.
Nothing on Capital Rush is financial, investment, legal, or tax advice. Capital Rush does not guarantee profits, funding, payouts, or any particular result. Trade alerts, automation, analytics, and content are provided for informational purposes only. Every trading decision, and every outcome, is your own responsibility.
Trading futures involves substantial risk of loss and is not suitable for everyone. Most traders lose money. You should only trade with risk capital you can afford to lose. Past performance is not indicative of future results. For the full risk disclosure, see our Risk Disclaimer.
8. Automated execution risk.
If you enable automated execution, you authorize Capital Rush to place, modify, and manage orders on the account you have connected, based on system-generated signals. You can enable, pause, disable, or reconfigure automation at any time, and you remain responsible for your account settings, risk configuration, and position sizing.
Automated trading depends on technology and third-party systems and carries inherent risks, including latency, slippage, partial or missed fills, connectivity or vendor outages, and software errors. To the extent permitted by law, Capital Rush is not liable for losses arising from these risks. Before enabling automation, confirm that automated trading is permitted by your broker and prop firm.
9. Prop-firm compliance.
You are solely responsible for understanding and following the rules, terms, and trading parameters of any prop firm or funded-account provider you use. Prop-firm rules change frequently — always verify current requirements directly with your firm.
Capital Rush is independent and is not affiliated with, endorsed by, or partnered with any proprietary trading firm, including but not limited to Apex Trader Funding, Topstep, MyFundedFutures, Take Profit Trader, Tradeify, Bulenox, or FTMO. Any use of a firm's name is for identification only.
10. Disclaimer of warranties.
The platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that signals will be profitable, that execution will be timely or complete, or that the platform will always be available.
11. Limitation of liability.
To the maximum extent permitted by law, Capital Rush and its owners, operators, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading losses, lost profits, lost data, account violations, or missed opportunities, arising from your use of the platform. Your use of the platform is at your sole risk. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
12. Indemnification.
You agree to indemnify and hold harmless Capital Rush from any claims, damages, losses, or expenses arising from your use of the platform, your trading activity, or your violation of these terms or of any prop-firm or broker rules.
13. Termination.
You may stop using the platform and cancel your subscription at any time. We may suspend or terminate your access if you violate these terms, abuse the service, or create risk for us or other members. On termination, your license to use the platform ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and governing law) continue to apply.
14. Changes to these terms.
We may update these terms as the platform evolves. When we make material changes we will revise the effective date and, where appropriate, notify you. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.
15. Governing law.
These terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict-of-law provisions.
